What is a Class Action Lawsuit?
A class action lawsuit is a lawsuit in which many people with similar grievances against the same party are represented by one or more representative plaintiffs. A Class Action lawsuit allows a large set of claimants that have suffered the same kinds of harm or damages to come together and make a single claim against the alleged wrongdoer or wrongdoers, allowing them to resolve a much larger set of lawsuits in one ruling.
What is Certification
Certification is when the Court rules that the plaintiffs named in the Statement of Claim are sufficiently related, thus approving the lawsuit to proceed through the Class Action process.
First, the Statement of Claim is filed with the Court, where the Court determines if the complainants are similar enough for the lawsuit is appropriate to proceed by way of the Class Action process. This generally takes several months or even years, and the Statement of Claim, including who makes up the proposed “classes” of plaintiffs, often undergoes several changes as directed by the Court.
